These Terms and Conditions ("Terms") govern your use of Functionally Fit, a trading name of The Chronic Yogini Ltd ("we," "us," "our"). By using our services, you agree to these Terms. If you do not agree, you must not use our services.

2. Services Provided

Functionally Fit provides personal training and coaching services via in-person sessions and a mobile application. The services include but are not limited to:

  • Pre-made and recorded yoga videos, workouts, and training programmes.
  • Customised workout plans and progress tracking.
  • Calorie and macronutrient recommendations.

All services are provided equally regardless of whether accessed in person or via the app.

3. User Eligibility

Users must be 18 years of age or older. Users under 18 require explicit parental consent to use our services.

By using our services, you confirm that the information you provide is accurate and complete.

4. Health and Safety

You acknowledge that participating in workouts involves inherent risks. We are not responsible for any injuries or health issues arising from participation.

Users are required to disclose relevant health information to ensure appropriate exercise recommendations. This information is used solely to enhance the safety and effectiveness of the programme.

We do not provide health monitoring or medical advice.

5. Payment and Subscriptions

Payments are processed via Stripe and RevenueCat.

All plans are subject to the following terms:

  • Subscription fees are charged monthly in advance.
  • Cancellations require one full month's notice. For example, if you wish to terminate your subscription, you must notify us before the start of the next monthly cycle.
  • No refunds are provided for our digital services due to the 14-day free trial period offered. For personalised offline services (e.g., programmes designed by Shruti), the service is deemed to have been received and consumed at the point of receipt, and therefore no refunds are available.

6. Termination

We reserve the right to terminate or suspend your account if you violate these Terms or engage in unlawful or inappropriate behaviour.

Upon account termination, we will retain your data for 12 months before permanent deletion. During this period, you may request a copy of your data by contacting us at legal@thechronicyogini.com.

7. Privacy and Data Collection

Our Privacy Policy governs how we collect, use, and store your data. By using our services, you agree to the terms outlined in our Privacy Policy.

8. Intellectual Property

All content provided through Functionally Fit, including videos, programmes, and app features, is the property of The Chronic Yogini Ltd.

You may not copy, reproduce, or distribute our content without prior written consent.

9. Communication

All communication will be conducted in English.

10. Limitation of Liability

We are not liable for any indirect or consequential damages arising from the use of our services.

Our maximum liability is limited to the subscription fee paid by you for the current month.

11. Governing Law and Dispute Resolution

In the event of any dispute arising from or relating to these Terms or our services, both parties agree to first attempt to resolve the dispute informally by contacting the other party. If a dispute is not resolved within 30 days of submission, either party may initiate formal legal proceedings.

If the dispute cannot be resolved informally, the parties agree to seek resolution through mediation before resorting to litigation. The mediation will be conducted by a mutually agreed upon mediator in accordance with the Centre for Effective Dispute Resolution (CEDR) Model Mediation Procedure.

12. Changes to Terms

We may update these Terms from time to time. Any changes will be communicated to you via email and through in-app notifications. Continued use of our services after such notifications constitutes acceptance of the updated Terms.
